Wir freuen uns über Ihr Interesse an Cookini. Der Schutz Ihrer personenbezogenen Daten ist uns ein wichtiges Anliegen. Nachfolgend informieren wir Sie gemäß Art. 13 und 14 der Datenschutz-Grundverordnung (DSGVO) darüber, welche personenbezogenen Daten wir auf dieser Website verarbeiten und zu welchen Zwecken.
1. Verantwortliche und gemeinsame Verantwortlichkeit
Verantwortlicher im Sinne des Art. 4 Nr. 7 DSGVO ist, soweit nachstehend nichts anderes bestimmt ist:

Gemeinsame Verantwortlichkeit für die Warteliste (Art. 26 DSGVO). Über die Zwecke und die wesentlichen Mittel der Verarbeitung im Rahmen der Cookini-Warteliste (Ziffer 5) entscheiden die vorstehend genannte Pfeifer Sebastian, Gerhard Maximilian GbR und die Gründerin des Projekts Cookini gemeinsam. Sie sind insoweit gemeinsam Verantwortliche im Sinne des Art. 26 Abs. 1 DSGVO. Zweite gemeinsam Verantwortliche ist:

Beide gemeinsam Verantwortlichen sind in Deutschland niedergelassen.
Zeitlicher Anwendungsbereich. Die gemeinsame Verantwortlichkeit gilt für Anmeldungen zur Warteliste ab dem 30. Juli 2026 — dem Tag, an dem die in Ziffer 5 beschriebenen Einwilligungserklärungen eingeführt wurden. Für E-Mail-Adressen, die vor diesem Tag eingesammelt wurden, ist bis auf Weiteres allein die Pfeifer Sebastian, Gerhard Maximilian GbR verantwortlich; sie werden erst dann von der gemeinsamen Verantwortlichkeit erfasst, wenn die betroffene Person ihre Einwilligung auf der in Ziffer 5 beschriebenen Grundlage bestätigt hat (siehe dort den Abschnitt „Anmeldungen vor dem 30. Juli 2026“).
Sachlicher Anwendungsbereich und Abgrenzung. Die gemeinsame Verantwortlichkeit umfasst ausschließlich die in Ziffer 5 beschriebene Verarbeitung — die Anmeldung zur Warteliste, den Nachweis der erteilten Einwilligungen und den Versand der Wartelisten-E-Mails — sowie die hierauf bezogenen Angaben zur Speicherdauer in Ziffer 11. Für alle übrigen in dieser Datenschutzerklärung beschriebenen Verarbeitungen ist die Pfeifer Sebastian, Gerhard Maximilian GbR allein verantwortlich, namentlich für Hosting und Server-Logfiles (Ziffer 3), für die Speicherung Ihrer Einwilligungsentscheidung in Ihrem Browser (Ziffer 4), für die Einbindung und den Betrieb der Dienste Google reCAPTCHA, Google Hosted Libraries und Amazon CloudFront einschließlich der damit verbundenen Übermittlungen (Ziffer 6–9) sowie für die Bearbeitung von Kontaktanfragen (Ziffer 10). Soweit in dieser Datenschutzerklärung „wir“ steht, sind damit im Zusammenhang mit der Warteliste beide gemeinsam Verantwortlichen gemeint, im Übrigen die Pfeifer Sebastian, Gerhard Maximilian GbR.
Gemeinsame Anlaufstelle für betroffene Personen (vgl. Art. 26 Abs. 1 S. 3 DSGVO). Für alle Fragen zum Datenschutz und zur Ausübung Ihrer Rechte wenden Sie sich bitte an die Pfeifer Sebastian, Gerhard Maximilian GbR unter der oben genannten Anschrift oder an info@gpcodelabs.com. Dort eingehende Anliegen werden für beide gemeinsam Verantwortlichen bearbeitet; Ocucídia da Piedade Guijomene Maxaieie wird eingebunden, soweit dies zur Bearbeitung Ihres Anliegens erforderlich ist. Anliegen, die sich unmittelbar an sie richten, können Sie an die vorstehend genannte Zustellanschrift (c/o) richten; sie werden ihr unverzüglich weitergeleitet.
Verteilung der Verantwortlichkeiten. Die Aufgaben sind zwischen den gemeinsam Verantwortlichen wie folgt verteilt:
- Gemeinsam: die Entscheidung über die Zwecke der Wartelisten-Verarbeitung, über die Inhalte der Wartelisten-E-Mails sowie über Inhalt und Wortlaut der Einwilligungserklärungen und der Ziffern 1 und 5 dieser Datenschutzerklärung.
- Pfeifer Sebastian, Gerhard Maximilian GbR: der Betrieb dieser Website und der eingesetzten technischen Systeme einschließlich der Auswahl, Einbindung und des Betriebs der in Ziffer 3, 4 und 6–8 beschriebenen Dienste; der Betrieb des für den Versand genutzten CleverReach-Kontos; der Abschluss und die Einhaltung der Verträge über die Auftragsverarbeitung nach Art. 28 DSGVO; die Erfüllung der Informationspflichten nach Art. 13 und 14 DSGVO auf dieser Website; die Dokumentation und der Nachweis der erteilten Einwilligungen nach Art. 7 Abs. 1 DSGVO; die Entgegennahme und Bearbeitung von Anfragen betroffener Personen über die gemeinsame Anlaufstelle; die Führung des Verzeichnisses von Verarbeitungstätigkeiten nach Art. 30 DSGVO für die gemeinsam verantwortete Verarbeitung; die Umsetzung der technischen und organisatorischen Maßnahmen nach Art. 32 DSGVO sowie die Meldung und Benachrichtigung bei Verletzungen des Schutzes personenbezogener Daten nach Art. 33 und 34 DSGVO.
- Ocucídia da Piedade Guijomene Maxaieie: die inhaltliche Ausrichtung des Projekts Cookini und der an die Warteliste gerichteten Kommunikation sowie die Mitwirkung bei der Beantwortung von Anfragen betroffener Personen, soweit dies zu deren Bearbeitung erforderlich ist.
Ihre Rechte gegenüber jedem Verantwortlichen. Unabhängig von dieser Aufgabenverteilung können Sie die Ihnen nach der DSGVO zustehenden Rechte (Ziffer 2) bei und gegenüber jedem einzelnen der gemeinsam Verantwortlichen geltend machen (Art. 26 Abs. 3 DSGVO). Die gemeinsame Anlaufstelle ist hierfür der einfachste Weg; Sie sind an sie nicht gebunden.
Geplante Überführung des Projekts. Das Projekt Cookini soll in eine noch zu gründende Gesellschaft überführt werden, die es fortführt; diese Gesellschaft würde in Deutschland gegründet. Ihr Name, ihre Rechtsform und der Zeitpunkt der Gründung stehen nicht fest, und ob es zu der Überführung überhaupt kommt, steht heute ebenfalls nicht fest. Kommt es dazu, nennen wir die Gesellschaft in dieser Datenschutzerklärung. Unter welchen Voraussetzungen Ihre E-Mail-Adresse dabei übertragen wird und wie Sie widersprechen können, beschreibt Ziffer 5.
Ende der gemeinsamen Verantwortlichkeit. Endet die Zusammenarbeit der gemeinsam Verantwortlichen, ohne dass es zu der vorgenannten Überführung kommt, erhält Ocucídia da Piedade Guijomene Maxaieie zur Fortführung des Projekts Cookini eine vollständige Kopie des Wartelisten-Datenbestands einschließlich der Einwilligungsnachweise; die Pfeifer Sebastian, Gerhard Maximilian GbR löscht ihre Bestände, soweit keine gesetzlichen Aufbewahrungs- oder Nachweispflichten entgegenstehen. Da beide gemeinsam Verantwortlichen in Deutschland niedergelassen sind, ist damit keine Übermittlung in ein Drittland verbunden. Ihre Abmeldemöglichkeit bleibt davon unberührt; auf eine solche Änderung weisen wir in dieser Datenschutzerklärung hin.
Die Pfeifer Sebastian, Gerhard Maximilian GbR hat keinen Datenschutzbeauftragten bestellt, da hierfür keine gesetzliche Verpflichtung besteht (Art. 37 DSGVO, § 38 BDSG). Diensteanbieterin dieser Website im Sinne des § 5 DDG ist die Pfeifer Sebastian, Gerhard Maximilian GbR; weitere Angaben zu ihr finden Sie in unserem Impressum.
2. Ihre Rechte als betroffene Person
Ihnen stehen gegenüber uns hinsichtlich der Sie betreffenden personenbezogenen Daten folgende Rechte zu:
- Recht auf Auskunft (Art. 15 DSGVO),
- Recht auf Berichtigung (Art. 16 DSGVO),
- Recht auf Löschung (Art. 17 DSGVO),
- Recht auf Einschränkung der Verarbeitung (Art. 18 DSGVO),
- Recht auf Datenübertragbarkeit (Art. 20 DSGVO),
- Recht auf Widerspruch gegen die Verarbeitung (Art. 21 DSGVO).
Soweit die Verarbeitung auf Ihrer Einwilligung beruht (Art. 6 Abs. 1 lit. a DSGVO), haben Sie das Recht, diese Einwilligung jederzeit mit Wirkung für die Zukunft zu widerrufen (Art. 7 Abs. 3 DSGVO). Die Rechtmäßigkeit der bis zum Widerruf erfolgten Verarbeitung bleibt unberührt.
3. Hosting und Server-Logfiles
Diese Website wird bei der Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Deutschland, gehostet. Beim Aufruf der Website erhebt und speichert der Server automatisch Informationen in sogenannten Server-Logfiles, die Ihr Browser automatisch übermittelt: IP-Adresse, Datum und Uhrzeit des Zugriffs, aufgerufene Seite, Referrer-URL sowie Browsertyp und Betriebssystem. Diese Daten dienen der technischen Bereitstellung, der Sicherheit und der Stabilität der Website und werden spätestens nach 7 Tagen automatisch gelöscht. Rechtsgrundlage ist unser berechtigtes Interesse an einem sicheren und funktionsfähigen Betrieb (Art. 6 Abs. 1 lit. f DSGVO). Mit Hetzner besteht ein Auftragsverarbeitungsvertrag gemäß Art. 28 DSGVO.
4. Cookies und Einwilligungsverwaltung
Auf unseren allgemeinen Seiten setzen wir keine Tracking-, Analyse- oder Marketing-Cookies ein. Um Ihre Entscheidung über einwilligungspflichtige Dienste (siehe Ziffer 6–8) zu speichern, legen wir eine technisch notwendige Information in der lokalen Speicherung (localStorage) Ihres Browsers ab (Schlüssel cookini:consent:thirdparty). Diese Speicherung ist zur Bereitstellung des von Ihnen gewünschten Dienstes unbedingt erforderlich (§ 25 Abs. 2 TDDDG) und bedarf keiner Einwilligung.
Drittanbieter, die Informationen auf Ihrem Endgerät speichern oder abrufen (insbesondere Google reCAPTCHA), werden erst geladen, nachdem Sie auf der Warteliste-Seite ausdrücklich eingewilligt haben (§ 25 Abs. 1 TDDDG). Ihre Einwilligung können Sie jederzeit über unsere Cookie-Richtlinie widerrufen.
5. Warteliste / Newsletter (CleverReach)
Für die Anmeldung zu unserer Warteliste nutzen wir den Dienst der CleverReach GmbH & Co. KG, Schafjückenweg 2, 26180 Rastede, Deutschland (nachfolgend „CleverReach“). Das Anmeldeformular auf der Wartelisten-Seite wird von CleverReach bereitgestellt und übermittelt Ihre Eingaben direkt an CleverReach.
Verantwortliche und Absenderin: Die Warteliste führen die in Ziffer 1 genannten gemeinsam Verantwortlichen — die Pfeifer Sebastian, Gerhard Maximilian GbR und Ocucídia da Piedade Guijomene Maxaieie. Ihre Einwilligung erteilen Sie gegenüber beiden. Technische Absenderin der Wartelisten-E-Mails ist die Pfeifer Sebastian, Gerhard Maximilian GbR; über die Inhalte entscheiden beide gemeinsam Verantwortlichen gemeinsam. Für Anmeldungen vor dem 30. Juli 2026 gilt die Einschränkung am Ende dieser Ziffer.
Zwei getrennte Einwilligungen: Das Anmeldeformular enthält zwei voneinander unabhängige Einwilligungserklärungen, die Sie jeweils gesondert ankreuzen und die beide nicht vorangekreuzt sind:
- Einwilligung in den Erhalt der Wartelisten-E-Mails. Sie ist Voraussetzung der Anmeldung, weil wir Ihnen ohne sie keine E-Mails senden dürfen.
- Einwilligung in die Übertragung an die noch zu gründende Gesellschaft. Sie ist freiwillig. Sie können sich in die Warteliste eintragen, ohne sie zu erteilen; die Aufnahme in die Warteliste und der Erhalt der Wartelisten-E-Mails hängen nicht von ihr ab. Sie können sie unabhängig von der ersten Einwilligung jederzeit widerrufen, ohne dass dies Ihren Platz auf der Warteliste berührt.
Verarbeitete Daten: Ihre E-Mail-Adresse, die Angabe, welche der beiden Einwilligungen Sie erteilt haben, sowie zum Nachweis Ihrer Einwilligung der Wortlaut der Erklärungen, denen Sie zugestimmt haben, und Zeitpunkt und IP-Adresse von Anmeldung und Bestätigung. Die Angabe Ihrer E-Mail-Adresse ist freiwillig; sie ist weder gesetzlich noch vertraglich vorgeschrieben. Ohne sie können wir Sie nicht in die Warteliste aufnehmen; andere Nachteile entstehen Ihnen nicht.
Double-Opt-In: Nach Ihrer Anmeldung erhalten Sie eine E-Mail, in der Sie um Bestätigung gebeten werden, dass Sie der Aufnahme in die Warteliste zustimmen. Erst nach Ihrer Bestätigung nehmen wir Ihre E-Mail-Adresse in die Warteliste auf. Dieses Verfahren dient dem Nachweis Ihrer Einwilligung und der Verhinderung eines Missbrauchs Ihrer Daten.
Zweck und Rechtsgrundlage: Wir verarbeiten Ihre Daten ausschließlich, um Ihnen per E-Mail Folgendes zu senden:
- Neuigkeiten zum Start von Cookini,
- Angebote für einen frühzeitigen Zugang zu Cookini und
- Einladungen zu Koch- und Ess-Veranstaltungen.
Rechtsgrundlage ist Ihre Einwilligung (Art. 6 Abs. 1 lit. a DSGVO i. V. m. § 7 Abs. 2 UWG). Für die Übertragung an die noch zu gründende Gesellschaft ist Rechtsgrundlage Ihre gesonderte, freiwillige Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Zu anderen Zwecken verwenden wir Ihre Daten nicht; insbesondere geben wir Ihre E-Mail-Adresse nicht für Werbung Dritter weiter.
Widerruf und Abmeldung: Sie können jede der beiden Einwilligungen jederzeit, kostenlos und ohne Angabe von Gründen mit Wirkung für die Zukunft widerrufen (Art. 7 Abs. 3 DSGVO) — über den Abmeldelink in jeder Wartelisten-E-Mail oder mit einer Nachricht an die in Ziffer 1 genannte Anlaufstelle. Widerrufen Sie die Einwilligung in den Erhalt der Wartelisten-E-Mails, entfernen wir Ihre E-Mail-Adresse aus dem Verteiler und nehmen sie in eine Sperrliste auf, damit Sie keine weiteren Wartelisten-E-Mails erhalten. Die Nachweise zu Ihren Einwilligungen und zu Ihrem Widerruf — der Wortlaut der Erklärungen sowie Zeitpunkt und IP-Adresse von Anmeldung, Bestätigung und Widerruf — bewahren wir darüber hinaus für die Dauer der gesetzlichen Verjährungsfristen auf, um unserer Rechenschafts- und Nachweispflicht nachzukommen (Art. 5 Abs. 2, Art. 7 Abs. 1 DSGVO, § 7 Abs. 2 UWG); zu anderen Zwecken verarbeiten wir sie nicht. Rechtsgrundlage hierfür ist unser berechtigtes Interesse an der Nachweisbarkeit der Rechtmäßigkeit der Verarbeitung und an der Rechtsverteidigung (Art. 6 Abs. 1 lit. f DSGVO) sowie, soweit gesetzliche Aufbewahrungspflichten bestehen, Art. 6 Abs. 1 lit. c DSGVO. Die Rechtmäßigkeit der bis zum Widerruf erfolgten Verarbeitung bleibt unberührt.
Geplante Übertragung an eine noch zu gründende Gesellschaft: Das Projekt Cookini soll in eine noch zu gründende Gesellschaft überführt werden, die es fortführt (Ziffer 1); diese Gesellschaft würde in Deutschland gegründet. Haben Sie die zweite, freiwillige Einwilligung erteilt, dürfen Ihre E-Mail-Adresse und die Nachweise zu Ihren Einwilligungen — der Wortlaut der Erklärungen sowie Zeitpunkt und IP-Adresse von Anmeldung und Bestätigung — zu diesem Zweck an diese Gesellschaft übertragen werden, und diese darf Ihnen ausschließlich zu den vorstehend genannten Zwecken weiter schreiben. Name, Rechtsform und Zeitpunkt der Gründung stehen nicht fest, und ob es zu der Übertragung kommt, steht heute ebenfalls nicht fest.
Weil die Gesellschaft heute noch nicht benannt werden kann, verpflichten wir uns zusätzlich: Kommt es zu der Übertragung, nennen wir die Gesellschaft zuvor in dieser Datenschutzerklärung und teilen Ihnen mindestens 14 Tage vor der Übertragung per E-Mail ihren Namen, ihre Rechtsform und ihre Anschrift mit. In derselben E-Mail weisen wir Sie darauf hin, dass Sie der Übertragung und der Fortsetzung des Versands widersprechen können. Widersprechen Sie, wird Ihre E-Mail-Adresse nicht übertragen. Ob und durch wen Sie danach noch Wartelisten-E-Mails erhalten, teilen wir Ihnen in derselben E-Mail mit; erhalten Sie keine mehr, löschen wir Ihre E-Mail-Adresse aus der Warteliste und bewahren nur die vorstehend beschriebenen Einwilligungsnachweise auf. Haben Sie die freiwillige Einwilligung nicht erteilt oder widerrufen Sie sie vor der Übertragung, wird Ihre E-Mail-Adresse ebenfalls nicht übertragen.
Anmeldung ohne Google reCAPTCHA: Das Anmeldeformular wird zusammen mit Google reCAPTCHA und weiteren Diensten geladen (Ziffer 6–8), die eine Übermittlung in die USA mit sich bringen (Ziffer 9). Wenn Sie hierin nicht einwilligen möchten, können Sie sich auch formlos per E-Mail an info@gpcodelabs.com auf die Warteliste setzen lassen. Wir übermitteln Ihnen dann dieselben Einwilligungserklärungen und dieselbe Bestätigungs-E-Mail; auf der Warteliste stehen Sie auch auf diesem Weg erst nach Ihrer Bestätigung. Ihre Einwilligung in das Laden der genannten Dienste ist damit keine Voraussetzung für die Aufnahme in die Warteliste (Art. 7 Abs. 4 DSGVO, § 25 Abs. 1 TDDDG).
Empfänger: CleverReach verarbeitet die Daten im Auftrag der Pfeifer Sebastian, Gerhard Maximilian GbR auf Grundlage eines Auftragsverarbeitungsvertrags gemäß Art. 28 DSGVO (Ziffer 1). Empfänger Ihrer Daten sind damit CleverReach als Auftragsverarbeiterin, Ocucídia da Piedade Guijomene Maxaieie als gemeinsam Verantwortliche — auch im Fall der Beendigung der gemeinsamen Verantwortlichkeit zur Fortführung des Projekts Cookini (Ziffer 1) — sowie, nur soweit Sie die freiwillige Einwilligung erteilt und der Übertragung nicht widersprochen haben, die noch zu gründende Gesellschaft. Beim Laden des Anmeldeformulars werden zusätzlich Ihre IP-Adresse und Geräteinformationen an die in Ziffer 6–8 genannten Dienste übermittelt; welche Daten Google reCAPTCHA dabei im Einzelnen erfasst, beschreibt Ziffer 6. Weitere Informationen finden Sie in der Datenschutzerklärung von CleverReach: https://www.cleverreach.com/de/datenschutz/.
Anmeldungen vor dem 30. Juli 2026: E-Mail-Adressen, die vor diesem Tag — also vor Einführung der beiden vorstehend beschriebenen Einwilligungserklärungen — eingesammelt wurden, führen wir getrennt von den späteren Anmeldungen. Für sie ist bis auf Weiteres allein die Pfeifer Sebastian, Gerhard Maximilian GbR verantwortlich (Ziffer 1), und sie werden nicht an eine noch zu gründende Gesellschaft übertragen. Wir bitten die betroffenen Personen einmalig per E-Mail, ihre Einwilligung auf der in Ziffer 1 und in dieser Ziffer beschriebenen Grundlage zu bestätigen; diese Nachricht dient zugleich der Information über die geänderte Verarbeitung nach Art. 13 Abs. 3 DSGVO, enthält keine Werbung und nennt eine Frist. Erst mit der Bestätigung gilt die neue Grundlage; sie erfolgt wiederum im Double-Opt-In-Verfahren. Bestätigt eine betroffene Person nicht bis zum Ablauf der genannten Frist, löschen wir ihre E-Mail-Adresse aus der Warteliste und senden ihr keine weiteren Wartelisten-E-Mails; die Adresse wird weder an eine noch zu gründende Gesellschaft übertragen noch mit den späteren Anmeldungen zusammengeführt. Die Nachweise zu der ursprünglich erteilten Einwilligung und zu der Löschung bewahren wir wie vorstehend beschrieben auf.
6. Google reCAPTCHA
Das CleverReach-Anmeldeformular ist durch „reCAPTCHA“ von Google gegen automatisierte Eingaben (Spam) geschützt. Anbieter ist die Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland („Google“). reCAPTCHA wird erst nach Ihrer Einwilligung geladen.
Verarbeitete Daten: reCAPTCHA analysiert das Verhalten der Websitebesucher anhand verschiedener Merkmale. Hierzu übermittelt es u. a. die IP-Adresse, Informationen zu Betriebssystem, Browser und Verweildauer sowie Maus- und Tastatureingaben an Google und setzt hierfür Cookies. Die Datenverarbeitung erfolgt allein zum Zweck der Spam- und Missbrauchsabwehr.
Rechtsgrundlage: Die Speicherung und der Zugriff auf Informationen in Ihrem Endgerät sowie die anschließende Verarbeitung erfolgen ausschließlich auf Grundlage Ihrer Einwilligung (§ 25 Abs. 1 TDDDG, Art. 6 Abs. 1 lit. a DSGVO). Sie können die Einwilligung jederzeit widerrufen.

7. Google Hosted Libraries (jQuery)
Zusammen mit dem CleverReach-Formular wird — ebenfalls erst nach Ihrer Einwilligung — die Programmbibliothek „jQuery“ über das Content Delivery Network „Google Hosted Libraries“ (ajax.googleapis.com) der Google Ireland Limited geladen. Dabei wird Ihre IP-Adresse an Google übermittelt, da diese für die Auslieferung der Datei technisch erforderlich ist. Rechtsgrundlage ist Ihre Einwilligung (§ 25 Abs. 1 TDDDG, Art. 6 Abs. 1 lit. a DSGVO). Zur Datenübermittlung in die USA siehe Ziffer 9.
8. Amazon CloudFront (CleverReach-Grafik)
Das CleverReach-Formular bindet — erst nach Ihrer Einwilligung — eine Grafik („powered by CleverReach“) über das Content Delivery Network „Amazon CloudFront“ der Amazon Web Services, Inc., 410 Terry Avenue North, Seattle, WA 98109-5210, USA, ein. 9. Datenübermittlung in Drittländer
Bei der Nutzung der Dienste von Google und Amazon (Ziffer 6–8) kann es zu einer Übermittlung personenbezogener Daten in die USA kommen. Die Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) und die Amazon Web Services, Inc. sind unter dem EU-U.S. Data Privacy Framework zertifiziert; für Übermittlungen in die USA besteht damit ein Angemessenheitsbeschluss der Europäischen Kommission (Art. 45 DSGVO). Ergänzend haben die Anbieter Standardvertragsklauseln der EU-Kommission (Art. 46 Abs. 2 lit. c DSGVO) vereinbart. Wir weisen darauf hin, dass in den USA kein dem europäischen Recht vergleichbares Datenschutzniveau garantiert werden kann und insbesondere ein Zugriff durch US-Behörden nicht vollständig ausgeschlossen ist.

Thank you for your interest in Cookini. Protecting your personal data is important to us. Below we inform you, pursuant to Articles 13 and 14 of the General Data Protection Regulation (GDPR), which personal data we process on this website and for what purposes.
1. Controllers and joint controllership

Joint controllership for the waitlist (Art. 26 GDPR). The purposes and the essential means of the processing carried out for the Cookini waitlist (section 5) are determined jointly by the Pfeifer Sebastian, Gerhard Maximilian GbR named above and by the founder of the Cookini project. To that extent they are joint controllers within the meaning of Art. 26(1) GDPR. The second joint controller is:

Temporal scope. The joint controllership applies to waitlist sign-ups from 30 July 2026 onwards — the day on which the consent declarations described in section 5 were introduced. For e-mail addresses collected before that day, Pfeifer Sebastian, Gerhard Maximilian GbR remains the sole controller until further notice; they only become covered by the joint controllership once the data subject has confirmed their consent on the basis described in section 5 (see the paragraph "Sign-ups before 30 July 2026" there).
Material scope and delimitation. The joint controllership covers only the processing described in section 5 — sign-up to the waitlist, the record of the consents given, and the sending of the waitlist e-mails — together with the related storage periods set out in section 11. For all other processing described in this privacy policy, Pfeifer Sebastian, Gerhard Maximilian GbR is the sole controller, namely for hosting and server log files (section 3), for storing your consent decision in your browser (section 4), for integrating and operating the Google reCAPTCHA, Google Hosted Libraries and Amazon CloudFront services including the associated transfers (sections 6–9), and for handling contact enquiries (section 10). Where this privacy policy says "we", it means both joint controllers in connection with the waitlist, and otherwise Pfeifer Sebastian, Gerhard Maximilian GbR.
Joint contact point for data subjects (cf. Art. 26(1) sentence 3 GDPR). For all data protection questions and to exercise your rights, please contact Pfeifer Sebastian, Gerhard Maximilian GbR at the address given above or at info@gpcodelabs.com. Matters received there are handled on behalf of both joint controllers; Ocucídia da Piedade Guijomene Maxaieie is involved to the extent necessary to deal with your request. Matters addressed directly to her may be sent to the postal address (c/o) given above and are forwarded to her without undue delay.
Allocation of responsibilities. Responsibilities are allocated between the joint controllers as follows:
- Jointly: deciding on the purposes of the waitlist processing, on the content of the waitlist e-mails, and on the content and wording of the consent declarations and of sections 1 and 5 of this privacy policy.
- Pfeifer Sebastian, Gerhard Maximilian GbR: operating this website and the technical systems used, including the selection, integration and operation of the services described in sections 3, 4 and 6–8; operating the CleverReach account used for dispatch; concluding and complying with the processor agreements under Art. 28 GDPR; fulfilling the information duties under Art. 13 and 14 GDPR on this website; documenting and evidencing the consents given under Art. 7(1) GDPR; receiving and handling data subject requests via the joint contact point; maintaining the record of processing activities under Art. 30 GDPR for the jointly controlled processing; implementing the technical and organisational measures under Art. 32 GDPR; and notifying and communicating personal data breaches under Art. 33 and 34 GDPR.
- Ocucídia da Piedade Guijomene Maxaieie: deciding on the content and direction of the Cookini project and of the communication addressed to the waitlist, and contributing to answering data subject requests to the extent necessary to deal with them.
Your rights against either controller. Irrespective of this allocation, you may exercise the rights available to you under the GDPR (section 2) in respect of and against each of the joint controllers (Art. 26(3) GDPR). The joint contact point is the easiest route, but you are not bound to it.
Intended transfer of the project. The Cookini project is intended to be transferred to a company still to be founded that will continue it; that company would be founded in Germany. Its name, legal form and date of formation have not been determined, and whether the transfer will happen at all has not been decided either. If it does, we will name the company in this privacy policy. Section 5 explains on what conditions your e-mail address would be transferred and how you can object.
End of the joint controllership. If the cooperation between the joint controllers ends without the transfer described above taking place, Ocucídia da Piedade Guijomene Maxaieie receives a complete copy of the waitlist data, including the consent records, in order to continue the Cookini project; Pfeifer Sebastian, Gerhard Maximilian GbR deletes its holdings unless statutory retention or evidentiary obligations apply. As both joint controllers are established in Germany, this does not involve any transfer to a third country. Your ability to unsubscribe remains unaffected; we will note any such change in this privacy policy.
Pfeifer Sebastian, Gerhard Maximilian GbR has not appointed a data protection officer, as there is no legal obligation to do so (Art. 37 GDPR, § 38 BDSG). The service provider of this website within the meaning of § 5 DDG is Pfeifer Sebastian, Gerhard Maximilian GbR; further details about it are set out in our legal notice.
2. Your rights as a data subject
With regard to the personal data concerning you, you have the following rights: right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and objection (Art. 21). Where processing is based on your consent (Art. 6(1)(a) GDPR), you may withdraw that consent at any time with effect for the future (Art. 7(3) GDPR), without affecting the lawfulness of processing carried out before the withdrawal.
3. Hosting and server log files
This website is hosted by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. When you access the site, the server automatically collects and stores information in server log files that your browser transmits: IP address, date and time of access, page requested, referrer URL, browser type and operating system. This data serves the technical provision, security and stability of the website and is automatically deleted after no more than 7 days. The legal basis is our legitimate interest in secure and functional operation (Art. 6(1)(f) GDPR). A data processing agreement pursuant to Art. 28 GDPR is in place with Hetzner.
4. Cookies and consent management
On our general pages we do not use any tracking, analytics or marketing cookies. To store your decision regarding services requiring consent (see sections 6–8), we store a strictly necessary item in your browser's local storage (key cookini:consent:thirdparty). This storage is strictly necessary to provide the service you have requested (§ 25(2) TDDDG) and does not require consent. Third-party services that store or access information on your device (in particular Google reCAPTCHA) are only loaded after you have expressly consented on the waitlist page (§ 25(1) TDDDG). You may withdraw your consent at any time via our cookie policy.
5. Waitlist / newsletter (CleverReach)
To sign up for our waitlist we use the service of CleverReach GmbH & Co. KG, Schafjückenweg 2, 26180 Rastede, Germany ("CleverReach"). The sign-up form on the waitlist page is provided by CleverReach and transmits your input directly to CleverReach.
Controllers and sender: the waitlist is run by the joint controllers named in section 1 — Pfeifer Sebastian, Gerhard Maximilian GbR and Ocucídia da Piedade Guijomene Maxaieie. You give your consent to both of them. The technical sender of the waitlist e-mails is Pfeifer Sebastian, Gerhard Maximilian GbR; both joint controllers decide jointly on their content. For sign-ups before 30 July 2026, the restriction at the end of this section applies.
Two separate consents: the sign-up form contains two independent consent declarations, each ticked separately and neither pre-ticked:
- Consent to receiving the waitlist e-mails. This is a condition of signing up, because without it we may not send you any e-mails.
- Consent to the transfer to the company still to be founded. This consent is optional. You can join the waitlist without giving it; being added to the waitlist and receiving the waitlist e-mails do not depend on it. You may withdraw it at any time, independently of the first consent, without this affecting your place on the waitlist.
Data processed: your e-mail address, the record of which of the two consents you gave, and — as proof of your consent — the wording of the declarations you agreed to, together with the IP address and the time of sign-up and confirmation. Providing your e-mail address is voluntary; it is neither a statutory nor a contractual requirement. Without it we cannot add you to the waitlist, but you incur no other disadvantage.
Double opt-in: after you sign up, you receive an e-mail asking you to confirm that you agree to be added to the waitlist. Only after your confirmation do we add your e-mail address to the waitlist. This procedure serves to document your consent and to prevent misuse of your data.
Purpose and legal basis: we process your data solely in order to send you, by e-mail:
- news about the launch of Cookini,
- offers of early access to Cookini, and
- invitations to cooking and dining events.
The legal basis is your consent (Art. 6(1)(a) GDPR in conjunction with § 7(2) UWG). The legal basis for the transfer to the company still to be founded is your separate, optional consent (Art. 6(1)(a) GDPR). We do not use your data for any other purpose; in particular, we do not pass your e-mail address on for third-party advertising.
Withdrawal and unsubscribing: you may withdraw either consent at any time, free of charge and without giving reasons, with effect for the future (Art. 7(3) GDPR) — via the unsubscribe link in every waitlist e-mail or by writing to the contact point named in section 1. If you withdraw your consent to receiving the waitlist e-mails, we remove your e-mail address from the distribution list and add it to a suppression list so that you receive no further waitlist e-mails. Beyond that, we retain the records of your consents and of your withdrawal — the wording of the declarations and the IP address and time of sign-up, confirmation and withdrawal — for the duration of the statutory limitation periods in order to meet our accountability and evidentiary obligations (Art. 5(2), Art. 7(1) GDPR, § 7(2) UWG); we do not process them for any other purpose. The legal basis for this is our legitimate interest in being able to demonstrate the lawfulness of the processing and in defending legal claims (Art. 6(1)(f) GDPR) and, where statutory retention obligations apply, Art. 6(1)(c) GDPR. The lawfulness of processing carried out before the withdrawal remains unaffected.
Intended transfer to a company still to be founded: the Cookini project is intended to be transferred to a company still to be founded that will continue it (section 1); that company would be founded in Germany. If you gave the second, optional consent, your e-mail address and the records of your consents — the wording of the declarations and the IP address and time of sign-up and confirmation — may be transferred to that company for this purpose, and that company may write to you solely for the purposes stated above. Its name, legal form and date of formation have not been determined, and whether the transfer will happen has not been decided either.
Because the company cannot yet be named, we additionally undertake as follows: if the transfer takes place, we will name the company in this privacy policy beforehand and will tell you its name, legal form and address by e-mail at least 14 days before the transfer. In the same e-mail we will inform you that you may object to the transfer and to the continuation of the mailings. If you object, your e-mail address will not be transferred. That same e-mail will tell you whether, and from whom, you will receive waitlist e-mails after that; if you will receive none, we delete your e-mail address from the waitlist and retain only the consent records described above. If you did not give the optional consent, or if you withdraw it before the transfer, your e-mail address will likewise not be transferred.
Signing up without Google reCAPTCHA: the sign-up form is loaded together with Google reCAPTCHA and further services (sections 6–8) which involve a transfer to the USA (section 9). If you do not wish to consent to this, you can also ask to be added to the waitlist by informal e-mail to info@gpcodelabs.com. We will then send you the same consent declarations and the same confirmation e-mail; on this route too, you are only on the waitlist after you confirm. Your consent to loading those services is therefore not a condition of being added to the waitlist (Art. 7(4) GDPR, § 25(1) TDDDG).
Recipients: CleverReach processes the data on behalf of Pfeifer Sebastian, Gerhard Maximilian GbR under a data processing agreement pursuant to Art. 28 GDPR (section 1). The recipients of your data are therefore CleverReach as processor; Ocucídia da Piedade Guijomene Maxaieie as joint controller — including, if the joint controllership ends, for the purpose of continuing the Cookini project (section 1); and, only where you gave the optional consent and have not objected to the transfer, the company still to be founded. When the sign-up form is loaded, your IP address and device information are additionally transmitted to the services named in sections 6–8; section 6 describes in detail what Google reCAPTCHA records. Sign-ups before 30 July 2026: e-mail addresses collected before that day — that is, before the two consent declarations described above were introduced — are held separately from later sign-ups. Pfeifer Sebastian, Gerhard Maximilian GbR remains their sole controller until further notice (section 1), and they are not transferred to any company still to be founded. We ask the persons concerned once, by e-mail, to confirm their consent on the basis described in section 1 and in this section; that message also serves as the information about the changed processing required by Art. 13(3) GDPR, contains no advertising, and states a deadline. The new basis applies only upon confirmation, which again uses the double opt-in procedure. If a person does not confirm by that deadline, we delete their e-mail address from the waitlist and send them no further waitlist e-mails; the address is neither transferred to any company still to be founded nor merged with the later sign-ups. The records of the consent originally given and of the deletion are retained as described above.
6. Google reCAPTCHA
The CleverReach sign-up form is protected against automated input (spam) by Google "reCAPTCHA". The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). reCAPTCHA is only loaded after your consent. reCAPTCHA analyses visitor behaviour on the basis of various characteristics; for this purpose it transmits, among other things, the IP address, information about the operating system, browser and time spent, as well as mouse and keyboard input to Google, and sets cookies. This processing serves solely to prevent spam and abuse. The storage of and access to information on your device and the subsequent processing take place exclusively on the basis of your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR), which you may withdraw at any time. 7. Google Hosted Libraries (jQuery)
Together with the CleverReach form — also only after your consent — the "jQuery" program library is loaded via the "Google Hosted Libraries" content delivery network (ajax.googleapis.com) operated by Google Ireland Limited. Your IP address is transmitted to Google, as this is technically necessary to deliver the file. The legal basis is your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). See section 9 regarding transfers to the USA.
8. Amazon CloudFront (CleverReach graphic)
The CleverReach form embeds — only after your consent — a graphic ("powered by CleverReach") via the "Amazon CloudFront" content delivery network of Amazon Web Services, Inc., 410 Terry Avenue North, Seattle, WA 98109-5210, USA. When the graphic is loaded, your IP address is transmitted to Amazon. The legal basis is your consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). See section 9 regarding transfers to the USA.
9. Transfers to third countries
When using the Google and Amazon services (sections 6–8), personal data may be transferred to the USA. Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) and Amazon Web Services, Inc. are certified under the EU-U.S. Data Privacy Framework; an adequacy decision of the European Commission therefore applies to transfers to the USA (Art. 45 GDPR). In addition, the providers have agreed to the EU Commission's Standard Contractual Clauses (Art. 46(2)(c) GDPR). We point out that the USA cannot guarantee a level of data protection comparable to European law and that, in particular, access by US authorities cannot be entirely ruled out.
10. Contacting us
If you contact us via the contact form or by e-mail, we process the data you provide (name, e-mail address and your message) in order to handle and respond to your enquiry. The legal basis is our legitimate interest in responding to your enquiry (Art. 6(1)(f) GDPR), or Art. 6(1)(b) GDPR where the enquiry is aimed at concluding a contract. We delete the data as soon as it is no longer required for processing and no statutory retention obligations apply.
11. Storage period
We process and store personal data only for as long as necessary to achieve the respective purpose or as required by statutory retention periods. Waitlist data is stored until you unsubscribe or until the waitlist ends; server log files for up to 7 days.
12. SSL/TLS encryption
For security reasons, this website uses SSL/TLS encryption. You can recognise an encrypted connection by "https://" in your browser's address bar.
13. No automated decision-making
Automated decision-making, including profiling, within the meaning of Art. 22 GDPR does not take place.
14. Right to lodge a complaint
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR). The authority responsible for us is:
